FINAL SALE – NO REFUNDS, NO DISPUTES
This sale is final, non-cancellable, and non-refundable.
Warranty and Return Policy
The Seller provides a limited warranty for the forklift sold for a period of 30 calendar days from the date of delivery to the Buyer. This warranty covers only the major components: the engine and transmission fail ,that are not caused by the Buyer’s misuse, neglect, or unauthorized modifications.
The sole remedy under this warranty is replacement of the forklift with a comparable unit at the Seller’s discretion. No refunds will be issued under any circumstances.
To initiate a warranty claim, the Buyer must notify the Seller in writing within the warranty period and return the forklift in the same condition as it was delivered (excluding the reported defect), free from any additional damage, unauthorized repairs, or alterations.
The Buyer waives any rights to return the forklift, request a refund, dispute the payment. Seller may offer only exchange of the forklift. All delivery expenses connected to the exchange process are covered by the Buyer.
The Buyer acknowledges that they accepted the forklift in its current "AS-IS" condition, with limited warranty from the Seller.
The Buyer agrees that all claims, disputes, or chargebacks related to this purchase are strictly prohibited and automatically void under this Agreement.
By signing this Agreement, the Buyer acknowledges full satisfaction with the purchase and waives any right to future claims against the Seller.
4. TRANSFER OF OWNERSHIP & LIABILITY
The forklift ownership will be transferred to the Buyer only after the full payment has been received.
Upon receipt, the Buyer assumes full ownership and responsibility, including maintenance, repairs, and operational risks.
The Seller is not liable for any damages, malfunctions, or defects that may arise after the transfer of ownership.
5. AUTOMATIC VOID OF CHARGEBACKS & DISPUTES
By signing this Agreement, the Buyer explicitly acknowledges that:
- The payment was made knowingly, voluntarily, and with full understanding of the transaction.
- The Buyer CANNOT and WILL NOT initiate a chargeback, dispute, or refund request through their credit card provider, bank, or payment processor.
- If a chargeback or dispute is initiated despite this Agreement, the Buyer agrees that:
- This Agreement serves as irrefutable proof of the completed sale and product delivery.
- The chargeback or dispute is automatically void and must be denied by the payment processor.
- The Seller reserves the right to take legal action to recover all associated costs, including the sale amount, legal fees, and damages.
